1. Eligibility
You must be at least 18 years old to use the Service. By using AI Baby Generator you represent that you meet this requirement and that any information you provide is accurate. We do not offer the Service to minors under any circumstances, including with a parent’s permission.
2. The Service
AI Baby Generator uses artificial intelligence to generate an illustrative baby portrait from photos you upload. Results are an artistic, entertainment-focused visualisation — a creative approximation, not a prediction of any real child and not medical, genetic, or scientific information. Nothing produced by the Service should be relied on for any health or family-planning decision.
3. Your account
You are responsible for keeping your login credentials secure and for activity that happens under your account. Tell us promptly at support@mybabygenerator.com if you believe your account has been used without your permission. You can delete your account, and everything stored in it, at any time from your account settings.
4. Your content and rights
4.1 You keep what you upload
You retain ownership of the photos you upload. You grant us a limited, non-exclusive licence to process those photos solely to generate the result you requested, and that licence ends when the photos are deleted under the retention schedule in our Privacy Policy. We claim no other rights over them.
4.2 You need permission for every face
You must own or have permission to use every photo you upload, including the informed consent of every person appearing in it. If you upload a photo of a partner, friend, or anyone else, you confirm they agreed to it being used this way.
4.3 What you may do with the results
Subject to these Terms and payment of any applicable fees, the portraits you generate are yours. You may use them personally and commercially — print them, share them, put them on a card or a gift. We do not take a licence back over your generated portraits and we claim no ownership of them.
4.4 No photos of children
You must not upload a photo of anyone under 18, in any context, for any reason. This is not a formality: face-processing a child’s image is the single thing this Service will not do. Accounts that breach this are terminated immediately without refund, the images are deleted, and where the content is unlawful we will report it to the appropriate authorities.
4.5 We will not put you in our marketing
We do not use your uploaded photos or generated portraits in advertising, on our website, or in any promotional material unless you have given us separate written permission. Ticking these Terms is not that permission.
5. Acceptable use
You agree not to:
- Use the Service for any unlawful, harmful, harassing, or deceptive purpose;
- Upload images of anyone without their consent, or any image of a minor;
- Upload a photograph of a public figure or any person you do not personally know and have permission from;
- Upload sexual, violent, hateful, or otherwise abusive content;
- Attempt to reverse engineer, disrupt, overload, or gain unauthorised access to the Service;
- Use automated means to access the Service or resell access to it;
- Use the output to impersonate, defame, or mislead others.
6. Credits, plans, and payment
Certain features require credits or a paid plan. Prices are shown at checkout in US dollars and processed by Stripe. By purchasing you authorise us to charge your selected payment method for the amount shown, plus any tax that applies where you live.
Every purchase is a one-time payment. There is no subscription, nothing renews automatically, and you will never be charged again unless you choose to buy again. Photo credits do not expire. Refunds are governed by our Refund Policy.
7. Right of withdrawal for EU and UK consumers
If you are a consumer in the European Union or the United Kingdom, you normally have 14 days to withdraw from a distance contract. By purchasing and then generating a portrait, you expressly request that we begin supplying the digital content immediately and you acknowledge that you lose the right of withdrawal once supply has begun.
If you have not used any credits, that right is unaffected: you can withdraw within 14 days and receive a full refund with no deduction. See the Refund Policy.
8. Intellectual property
The Service, including its software, branding, and design, is owned by FUSIONHUB LLC and protected by intellectual-property laws. These Terms grant you no rights to our trademarks or underlying technology.
9. Copyright complaints (DMCA)
If you believe content on the Service infringes your copyright, send a notice under the Digital Millennium Copyright Act to our designated agent:

Your notice must identify the work, identify the material you say infringes it and where it is, give your contact details, and include statements that you believe in good faith the use is unauthorised and that the information is accurate — signed, under penalty of perjury, by you or someone authorised to act for you. We remove infringing material and terminate repeat infringers. You may send a counter-notice if your content was removed in error.
10. Disclaimers
The Service is provided “as is” and “as available” without warranties of any kind, whether express or implied, including any implied warranty of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that results will be accurate, resemble any actual person, or meet your expectations, or that the Service will be uninterrupted or error-free. Some jurisdictions do not allow these exclusions, so parts of this section may not apply to you.
11. Limitation of liability
To the maximum extent permitted by law, FUSIONHUB LLC will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, data, or goodwill arising from your use of the Service. Our total liability for any claim relating to the Service will not exceed the greater of the amount you paid us in the twelve months before the claim or 100 US dollars. Nothing here limits liability that cannot be limited by law, including for fraud or death or personal injury caused by negligence.
12. Indemnification
You agree to indemnify and hold harmless FUSIONHUB LLC, its officers, and its contractors from any claim, demand, loss, or expense (including reasonable legal fees) arising from content you upload, your breach of these Terms, your violation of any law, or your violation of another person’s rights — including a claim that you uploaded someone’s photograph without their permission. We may take over the defence of any such claim at your expense, and you will not settle it without our written agreement.
13. Termination
We may suspend or terminate your access if you breach these Terms or use the Service in a way that could harm us or others. You may stop using the Service at any time and delete your account from your settings. Sections 4.5, 8, and 10 to 17 survive termination.
14. Changes to these Terms
We may update these Terms from time to time. Material changes will be communicated by email or a notice on the site at least 14 days before they take effect where practicable. Continued use of the Service after an update constitutes acceptance of the revised Terms.
15. Governing law
These Terms are governed by the laws of the State of Montana, United States, without regard to its conflict-of-laws rules. If you are a consumer resident in the EU or UK, this does not deprive you of the protection of the mandatory consumer law of the country where you live, and you may bring proceedings in your local courts.
16. Dispute resolution, arbitration, and class-action waiver
Please read this section carefully — it affects your legal rights.
16.1 Talk to us first
Before starting any formal proceeding, email support@mybabygenerator.com describing the problem and what you would like us to do. Most disputes are resolved this way. Both sides agree to try in good faith for 30 days.
16.2 Binding arbitration
If that does not resolve it, you and FUSIONHUB LLC agree that any dispute arising out of these Terms or the Service will be resolved by binding individual arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules, rather than in court. The arbitration will be held in Montana or, at your election, remotely or in the county where you live.
16.3 Class-action waiver
You and FUSIONHUB LLC agree to bring claims only in an individual capacity, and not as a plaintiff or class member in any class, collective, consolidated, or representative proceeding. An arbitrator may not consolidate claims or preside over any form of class proceeding.
16.4 Exceptions
Either party may bring an individual claim in small-claims court, and either party may seek injunctive relief in court for infringement or misuse of intellectual property. If the class-action waiver in 16.3 is found unenforceable as to a particular claim, that claim proceeds in court and the rest of this section still applies to everything else.
16.5 Your right to opt out
You can decline arbitration. Email support@mybabygenerator.com with the subject “Arbitration opt-out” within 30 days of first accepting these Terms, including your name and account email. Opting out costs you nothing and changes nothing else about your use of the Service.
16.6 Consumers in the EU and UK
This section 16 does not apply to consumers resident in the European Union or the United Kingdom, who keep the right to bring proceedings in their local courts.
17. General
- Severability. If any provision is held unenforceable, it is limited or removed to the minimum extent necessary and the rest of these Terms stays in force.
- No waiver. Our failure to enforce a provision is not a waiver of it.
- Assignment. You may not assign these Terms without our written consent. We may assign them to a successor in connection with a merger, acquisition, or sale of assets.
- Force majeure. Neither party is liable for a failure to perform caused by events beyond its reasonable control, including outages at a provider we depend on.
- Notices. We contact you at the email on your account; you contact us at support@mybabygenerator.com.
- Entire agreement. These Terms, together with the Privacy Policy, Cookie Policy, and Refund Policy, are the whole agreement between you and us about the Service.
