Privacy Policy

The short version

• Photos you upload are permanently deleted within 24 hours of your portrait being generated. Automatically, whether or not you ask.
• We name every company that sees your photos. They are listed in full below — no vague “trusted partners”.
• We do not run facial recognition. We never create a faceprint, face template, or face geometry map, and we never try to identify anyone.
• Your photos are never used for advertising or AI training. Ever, for any purpose, by us or by anyone else.

1. Who we are

AI Baby Generator is operated by FUSIONHUB LLC, 1001 S Main St Ste 600, Kalispell, MT 59901, United States. We are the data controller for the personal information described in this Policy. You can reach us at support@mybabygenerator.com and we answer privacy requests within 48 hours.

2. Photos and facial data

2.1 What you upload

To generate a portrait you upload one or more photos containing the facial features of the parents. These images are used exclusively to create the baby portrait you requested.

2.2 What we do not do with them

We do not perform facial recognition. We do not extract, derive, or store a biometric identifier — no faceprint, no scan of face geometry, no facial template or embedding is retained after your portrait is produced. We do not attempt to identify, verify, match, or track any person, and we do not compare your photo against any database.

2.3 Who processes them

Generating a portrait requires sending your photo to a specialist AI image model. Depending on which model is active, that is OpenAI, L.L.C. and/or Google LLC, both acting as our service providers under contract and on servers in the United States. They generate the image and return it; they are not permitted to use your photo for their own purposes or to train their models on it.

While a generation is in progress, your photos are held in our own cloud storage in the United States. No other company receives them.

2.4 Retention schedule

These are the periods we actually enforce, in software, on a schedule that runs every hour:

• Photos you upload: permanently deleted within 24 hours of the generation finishing, successfully or not.
• Photos uploaded but abandoned before checkout: permanently deleted within 24 hours of upload.
• Facial templates or embeddings: never created, so there is nothing to retain.
• The portraits we generate for you: kept in your account until you delete them or close your account, because they are the product you paid for. You can delete any of them at any time.
• Account and billing records: kept while your account is open, and afterwards only as long as tax and accounting law requires.

Closing your account erases every image associated with it — both the photos you uploaded and the portraits generated from them — from our storage.

2.5 We do not ask about race or ethnicity

Some services in this category ask you to select the race of each parent. We do not, and we never will. We do not collect racial or ethnic origin, health data, or genetic data of any kind.

3. Other information we collect

3.1 Account information

• Email address
• Name (optional)
• Payment information — handled entirely by Stripe, Inc., our PCI-compliant payment processor. We never see or store full card details.

3.2 Automatically collected information

• Cookies used for sign-in and session management
• IP address, and the approximate country derived from it, for security and fraud prevention
• Browser type and device information
• Analytics about how the site is used — only if you agree to analytics cookies

4. How we use your data

• Generate portraits: your photos are processed by the AI model named in section 2.3 to create the result you requested.
• Service delivery: we use your email to deliver results and send account notifications.
• Service improvement: we review aggregated usage patterns — never your photos — to improve quality.
• Security: to keep the platform safe and prevent abuse and fraud.
• Support: to respond to your questions and requests.
• Measurement: with your consent, to understand which pages and campaigns bring people to the site.

5. What we never do

• We never sell, rent, or trade your photos or personal data.
• We never use your photos to train any AI model — ours or anyone else’s.
• We never use facial data for identification, profiling, or advertising.
• We never share your photos or facial data with advertising networks or data brokers.
• We never use your photos or generated portraits in our own marketing without asking you first, in writing.

6. Legal basis for processing

If you are in the European Economic Area or the United Kingdom, we rely on the following bases under the UK/EU GDPR:

• Your explicit consent (Article 9(2)(a)) to process the photographs of faces you upload. Facial imagery is a special category of personal data, and you give that consent when you upload. You can withdraw it at any time by deleting the images or your account, though that does not affect processing already carried out.
• Performance of a contract (Article 6(1)(b)) to generate and deliver your portraits, run your account, and take payment.
• Our legitimate interests (Article 6(1)(f)) in keeping the service secure and preventing fraud and abuse.
• Your consent (Article 6(1)(a)) for analytics and advertising cookies, which are off until you accept them.
• Legal obligation (Article 6(1)(c)) to keep tax and accounting records.

7. Sharing and international transfers

We share personal data only with the service providers we need to run the service:

• OpenAI, L.L.C. and/or Google LLC — AI image generation. Receives your uploaded photo. United States.
• Stripe, Inc. — payment processing and fraud prevention. Never receives your photos. United States.
• Google LLC — analytics and advertising measurement, only with your consent. Never receives your photos. United States.
• Our hosting and email providers — operating the site and delivering account email. United States.

We may also disclose information where the law requires it, or to protect our rights, safety, or property — and, if we are ever acquired or merged, to the acquiring party, who would remain bound by this Policy.

Our servers and providers are in the United States, so personal data of EEA and UK users is transferred there. Those transfers are covered by the European Commission’s Standard Contractual Clauses (and the UK Addendum), or by our providers’ certification under the EU–US Data Privacy Framework where applicable.

8. Data security

• All data is transmitted over encrypted connections (SSL/TLS).
• Stored images are reachable only through short-lived, signed links tied to your account.
• Images are processed in isolated environments.
• We apply industry-standard security controls to our systems.

9. Data breach notification

If a breach affects your personal data, we will notify the relevant supervisory authority within 72 hours of becoming aware of it where the law requires, and we will tell you directly and without undue delay when the breach is likely to present a high risk to you.

10. Your rights

Depending on where you live, you have the right to:

• Access the personal data we hold about you
• Request correction or deletion of your data
• Receive a copy of your data in a portable format, or have it transferred to another provider
• Object to or restrict certain processing
• Withdraw consent at any time
• Opt out of non-essential analytics and advertising cookies
• Lodge a complaint with your data protection authority — in the EU, the one where you live or work; in the UK, the ICO

You can delete individual portraits, and delete your entire account and everything in it, from your account settings without emailing anyone. For anything else, contact support@mybabygenerator.com. We reply within 48 hours and complete verified requests within 30 days, free of charge.

10.1 If you appear in someone else’s photo

Our Terms require the person uploading a photo to have the consent of everyone in it. If a photo of you was uploaded and you want it removed, email support@mybabygenerator.com. You do not need an account with us, and we will act on the request even though the upload was not yours.

11. Notice for California residents

Under the CCPA as amended by the CPRA, in the past 12 months we have collected these categories of personal information: identifiers (email, IP address); commercial information (purchases); internet activity (site usage); and sensitive personal information in the form of the photographs of faces you upload. Each is collected for the purposes in section 4 and disclosed only to the service providers in section 7.

• We do not sell your personal information, and we have not in the past 12 months.
• We do not share your photos or sensitive personal information for cross-context behavioural advertising. If you accept advertising cookies, standard Google advertising identifiers may count as “sharing” under California law; you can decline them at any time in cookie settings.
• Right to limit sensitive personal information: we already use your photos only to generate the portrait you asked for, which is a purpose the law permits without a limitation request. We do not use them to infer characteristics about you.
• We honour Global Privacy Control. If your browser sends the GPC signal, we treat it as an opt-out and never turn on advertising or analytics cookies.
• Non-discrimination: exercising any of these rights will never change the price you pay or the service you receive.

Residents of Colorado, Connecticut, Virginia, Texas, Oregon, Montana, and other states with comprehensive privacy laws have equivalent rights of access, correction, deletion, portability, and opt-out, and may appeal a refused request by replying to our decision.

12. Children’s privacy

AI Baby Generator is for adults. The service is not directed to anyone under 18, we do not knowingly collect information from minors, and our Terms prohibit uploading a photo of a child. If we learn that we hold information from or about a minor, we delete it. If you believe a child’s photo has been uploaded, email support@mybabygenerator.com and we will remove it.

13. Cookies and advertising

We use essential cookies to run the site, and — only with your consent — Google Analytics and Google Ads conversion measurement to see which campaigns bring people here. That measurement tells Google that a purchase happened; it never includes your photos, facial data, or generated portraits.

Nothing beyond the essential cookies is set until you accept. You can change your mind whenever you like in cookie settings, and the full detail is in our Cookie Policy.

14. Changes to this policy

We may update this Policy to reflect changes to the service or the law. Significant changes will be communicated by email or a notice on the site. Continued use of the service after an update constitutes acceptance of the revised Policy.
